Planning Commission to Conduct Hearing

The Planning Commission will hold a Public Hearing Tuesday, August 10, 5:30 PM, City Hall, to hear public comment on proposed zoning amendment for an Entertainment District (E-1).

The text of the amendment follows:

"DIVISION 8. E-1-ENTERTAINMENT DISTRICT

"Section 84.  E-1 – Entertainment District

"This District is composed of land and structures occupied by or suitable for uses for  businesses holding license to sell alcoholic beverages for on-premises consumption and further seeking to serve the public as a restaurant, lounge class I or club class I or club class II and which are not offensive to nearby commercial or residential uses.  This district is designed to promote the development of such activities in a centralized location preferably in a previously underdeveloped area which will allow for the design and development of appropriate infrastructure and traffic patterns to support such activities which have otherwise not been available in the community.

"PERMITTED USES.  Any retail establishment generally known or designated as a club, lounge, bar or similar designation which holds a Class I Lounge, Class I Club or Class II Club licensed to sell alcoholic beverages for on-premises consumption and Class I or II Restaurants licensed to sell alcoholic beverages for on-premises consumption or such other retail shopping establishments as may support and promote an Entertainment District which does not hold an alcohol license and which is otherwise permitted by law. 

"PERMITTED USES ON APPEAL: Restaurants without license to sell alcoholic beverages for on-premises consumption and a hotel with or without a retail license to sell alcoholic beverages for on-premises consumption.

"PROHIBITED USES:  Any establishment whether convenience store, package store, specialty beverage store or any establishment holding a retail license to sell alcoholic beverages for off-premise consumption.

"SPACE AND HEIGHT REGULATIONS:  

"MINIMUM LOT SIZE:  Minimum lot size for and establishment shall be a minimum of  2 Acres where no City sewage is provided and 1 acre where connection to the City Sewer is made and shall otherwise meet the minimum building and space requirements and parking requirements found in City of Haleyville, Alabama Alcohol Beverage Ordinance, Ordinance No. 2010-____.     

"Minimum Building Size: Must comply with the building requirements found in City of Haleyville, Alabama Alcohol Beverage Ordinance, Ordinance No. 2010-____ for the establishment sought to be licensed. 

"OFF STREET PARKING: Must comply with the building requirements found in City of Haleyville, Alabama Alcohol Beverage Ordinance, Ordinance No. 2010-____ for the establishment sought to be licensed. 

"MAXIMUM HEIGHT: Thirty (30) feet or two stories."
