Can gays and lesbians obtain a marriage license and be married in Winston County? Is same sex marriage legal in Winston County? It is now. For a short while in February of this year it was possible, but that changed, and then changed again. Today, same sex couples can obtain a marriage license in Winston County, as well as Cullman and Franklin Counties. But not Marion County.

A U.S. Supreme Court ruling on January 20, found Alabama"s prohibition against gay marriages unconstitutional. Alabama Supreme Court Judge, Roy Moore did not agree. For a short while, the Winston County Probate Judge Sheila Moore's office sold 4 same sex marriage licenses between February 10 and February 14. Since February, with a continuing legal battle being fought between Alabama and the Federal Government, same sex marriage licenses were not issued. No marriage ceremonies have been performed by Judge Moore since January 23.

She pointed out, she does not discriminate, she just does not perform marriage ceremonies for anyone. The license is available, but it will be up to the couple to find someone who can legally marry them.
