Charles Heavner Jr., wanted in connection with the arson at Marshall Durbin in Delmar Tuesday morning, was apprehended by the Kay County (Oklahoma) Sheriff's Department at approximately 2:41 AM Thursday, Winston County Sheriff Rick Harris said. Kay County is between Tulsa, Okla., and Wichita, Kan., on the Kansas-Oklahoma border, almost 700 miles from Delmar.
"(We) plan on extraditing (Heavner)," Harris said. He added that Heavner will also face federal charges.
THURSDAY 4:45 PM: Assistant District Attorney Neil Cook said that Heavner has waived extradiction and that arrangements are being made for his return to Alabama.
